DMV is currently establishing the process and procedures to support the legal use of dyed diesel fuel on Virgina roadways in accordance with Governor Spanberger’s directive issued on October 16, 2026. It will clarify the process to remit the state-owed diesel tax for utilization of dyed diesel on Virginia roadways.
DMV will publish the new process and procedures on this page on or before October 23, 2026.
The new process will:
- Streamline the process to pay backup tax as authorized under § 58.1-2225 to permit the use of dyed diesel on the Commonwealth’s roadways.
- Clarify how Virginia DMV will waive civil penalties for use of dyed diesel on roadways by persons who first pay the backup tax in accordance with authority granted under § 58.1-2265
This Executive Directive shall remain in full force and effect until December 31, 2026, unless extended or rescinded.
